Your Agreement With Us

Welcome to Targetly AI. These Terms and Conditions ("Terms") govern your use of the Targetly AI platform owned and operated by Targetly AI Company ("Company" or "we"). Please read these terms carefully before using our services. By using the platform, you acknowledge that you have read, understood, and agreed to be bound by all of these terms.

1. Definitions

  • 1.1 Platform: means the Targetly AI website and all services, applications, and tools associated with it provided by the Company.
  • 1.2 User: means any individual or entity that uses or accesses the Platform.
  • 1.3 Services: means all services provided through the Platform including: customer conversation management, conversational AI, WhatsApp bulk campaigns, analytics, reports, and team management tools.
  • 1.4 Account: means the account created by the User on the Platform to access the Services.
  • 1.5 Content: means all text, images, data, and information uploaded, created, or shared on the Platform.

2. Acceptance of Terms

  • By using the Platform, you acknowledge that you have read, understood, and agreed to be bound by all terms and conditions of this Agreement. If you do not agree with any of these terms, you must not use the Platform.
  • The Company reserves the right to modify these Terms at any time. We will notify you of any material modifications via email or notice within the Platform before they take effect. Your continued use of the Platform after posting modifications constitutes your acceptance of the modified Terms.
  • You must be at least 18 years old or the legal age in your country to use this Platform.

3. Account Creation and Registration

  • To use most of our services, you must create an account with accurate, complete, and current information.
  • You are responsible for maintaining the confidentiality of your password and account information. Do not share your account data with anyone else.
  • You must notify us immediately if you suspect your account has been compromised.
  • You may not transfer or sell your account to any other person without our prior written consent.
  • We reserve the right to refuse registration or cancel any account for any reason we deem appropriate.

4. Services Provided

  • Targetly AI provides an integrated platform for managing customer conversations across WhatsApp, Instagram, Facebook, Telegram, Email, and Live Chat.
  • Services are available on a subscription basis according to the various plans displayed on the Platform.
  • We reserve the right to modify, suspend, or add any services at any time with reasonable prior notice where possible.
  • The Platform may include integrations with third-party services. We are not responsible for the content or policies of these services.

5. Use of AI Employee

  • The Platform provides AI-powered employees ("AI Employees") designed to automate responses to your customers.
  • The AI Employee relies on the information you provide. The accuracy of responses depends on the quality of information entered in the knowledge base.
  • You are responsible for reviewing AI Employee responses and ensuring their accuracy before publishing them.
  • We are not liable for any inaccurate or misleading responses from the AI Employee.
  • Using the AI Employee to send spam or harmful content is a direct violation of these Terms.

6. Fees and Payment

  • All fees are quoted in US Dollars and may include applicable taxes based on your country.
  • Payment is due upfront for your chosen subscription period (monthly or annual).
  • If payment is not made by the due date, we may suspend or terminate your access to the Services.
  • We reserve the right to modify prices with reasonable advance notice before your subscription renews.
  • We use secure payment processors to handle all payments.

7. Cancellation and Refund Policy

  • You can cancel your subscription at any time from your account settings or by contacting us directly.
  • Upon cancellation, the Service remains active until the end of your current billing period. Automatic billing does not resume after cancellation.
  • There are no cancellation fees or penalties of any kind.
  • Paid fees will only be refunded in cases required by law or in the event of a material technical error on our part.

8. Acceptable Use

You are authorized to use the Services in accordance with these Terms and the subscription plan you have chosen. You are prohibited from:

  • Using the Platform for any unlawful purpose
  • Sending spam or harmful content
  • Violating the intellectual property rights of any third party
  • Attempting to hack or tamper with the Platform
  • Sending abusive, inciting, or hate-promoting content
  • Using the Platform to harass other Users
Note: We reserve the right to suspend or terminate any account that violates these Terms immediately and without prior notice.

9. Intellectual Property

  • Targetly AI retains all intellectual property rights in the Platform, Services, designs, and source code.
  • These Terms do not grant you any rights to our intellectual property except for the limited right to use it.
  • All your content remains your property. Targetly AI does not own your conversation content or customer data.

10. Privacy and Data Security

  • Your data is stored on a private dedicated server for your business only in Frankfurt, Germany. There is no shared infrastructure with other customers.
  • We do not sell, rent, or share your personal data or customer data with third parties under any circumstances.
  • All data is encrypted in transit using TLS and at rest.
  • Data access is based on a granular permissions system — each team member sees only what they are authorized to see.

11. Service Termination

  • You can terminate your account at any time through account settings or by contacting us.
  • We may suspend or terminate your account immediately in case of breach of these Terms.
  • Upon account termination, your data remains on the server for 30 days and is then permanently deleted. You can export your data at any time before termination.

12. Disclaimer

  • Services are provided "as is" and "as available" without any express or implied warranties.
  • We do not guarantee that Services will be continuously available or error-free at all times.
  • We assume no liability for any direct or indirect loss or damage resulting from your use of the Services.

13. Governing Law and Dispute Resolution

  • In the event of any dispute, we encourage resolution through friendly communication by first contacting us at [email protected].
  • If the dispute is not resolved amicably within 60 days, you may pursue legal action through the appropriate authorities.
  • These Terms are governed by and interpreted according to the laws of the Arab Republic of Egypt. Any dispute arising from these Terms is subject to the jurisdiction of the competent courts in the Arab Republic of Egypt.
